Business Agreement Summary
Recitals
Utah Family Housing agrees to provide real estate services to the Seller (or Buyer) under the terms of the executed Listing Agreement or Buyer Representation Agreement.

Sale Dates and Listing Period
The property will be listed and marketed for a mutually agreed-upon period. The Seller agrees to make the property available for showings during reasonable hours.
Compensation
- Utah Family Housing will receive a commission as outlined in the Listing Agreement, typically a percentage of the final sale price.
- Commission is payable at closing through escrow.
- Additional fees for services outside the standard scope will be agreed upon in advance.
Payment Terms
- Commissions are paid at closing.
- Any refunds or adjustments will be handled as specified in the agreement.
Responsibilities
- Utah Family Housing: Responsible for marketing, facilitating showings, and transaction management.
- Seller/Buyer: Responsible for providing accurate information, property access, and cooperation throughout the process.
Termination Clause
Either party may terminate the agreement in writing as specified in the Listing or Buyer Representation Agreement. Obligations regarding commissions on pending transactions will survive termination.
Liability
Utah Family Housing is not liable for loss or damage to property or financial loss related to the transaction except in cases of gross negligence or willful misconduct.
Miscellaneous
- Confidentiality of agreement terms is required.
- All services are provided "as-is" with no warranties beyond those legally required.
- Force majeure applies for events beyond control (natural disasters, etc.).
- Disputes will be addressed first via mediation before legal action.
- Written notices must be delivered personally, by certified mail, or email.
- If any provision is invalid, the rest remain effective.
- Governing law: State of Utah.
- This agreement supersedes prior agreements.
